Update on the Sustainable Use Directive

Defra is expected to publish regulations this spring that implement the Sustainable Use Directive (SUD). Member states were supposed to implement the Directive by November 2011, but Defra’s timetable has slipped. These regulations will effectively:

• remove grandfather rights for sprayer operators,
• encourage continuous professional development (CPD) of sprayer operators and
• require mandatory sprayer testing initially within five years and then every three years.

The NFU have been very active in the debate over the development of the SUD over the past few years and have worked very hard to minimise the impact on farming. The key thing for members is that most of the main measures actually duplicate or are very similar to arrangements that have already been in place in the UK (but not across the EU) for many years, so there should be no hidden surprises.

However, one potential area of continuing concern for the NFU is that anyone purchasing a pesticide will have to hold a suitable qualification or evidence of training. In effect this means that “grandfather rights” (operators born before 31 Dec 1963) will go. Therefore, work certainly hasn’t stopped for the NFU and whilst we await the regulation to formally come into force, discussions with Defra and other key stakeholders on the practicalities of its implementation are on-going.

Meanwhile, whilst we await publication of the regulations and further official news from Defra, you may find the attached short briefing on the SUD helps fill in some of the detail and helps address any questions.

    I have a small area of land and use a knapsack sprayer to control weeeds in grassland. If I need large areas sprayed I call in my local contractor.I have safely sprayed since 1962. Surely there should be some form of derogation to cover this type of situation.

    The loss of grandfather rights is not acceptable in fact it is down right insulting in that it assumes that we grandfathers are not competant. I have been using and maintaining my sprayer for 45+years and my son for 20+years without trouble. The proposal that I must now take a course will cost money for the benefit of someone with less experience than I have and does not know my sprayer. How will this cope with syndicates buying for a group of farmers and growers? Bin the idea. grandfather's rights will die out in time.

    Do DEFRA seriously think it is a good idea to have operators of on tractor sprays get qualifications when some may have left school over half a century ago. Surely anyone with half a brain can work out that the cost of herbicides and pesticides is sufficient to ensure they are applied at the correct rate and that the sprayer is calibrated correctly. My wife oversaw spray training days for the company she worked for. The younger staff members could pass the test no problem, the 50 plus age group could do the practical but the theory actually reduced grown men to tears. Not the best way to win friends and influence people
