The Environment Agency consultation focused on the implementation of the new civil sanctions and asked questions on their revised enforcement policy and guidance and safeguards they aim to put in place to ensure that the powers are used proportionally and consistently.
The Environment Agency are the first Government agency to be awarded the new civil sanctioning powers that aim to provide more flexible and proportionate enforcement options that work alongside existing choices to achieve better outcomes for business, people and the environment.
The NFU have agreed in principle with the introduction of the new civil sanctions but have raised concerns on how they will overlap with current enforcement possibilities that farmers face. We have also called for review periods to be in place and further consultation on future areas of legislation that the powers may be used for.
