The Via East Midlands Rights of Way team, in partnership with Nottinghamshire County Council are sending out letters reminding farmers of arable land in the county of the need to keep footpaths or bridleways free from obstruction by crops.
The letter (below) sets out the legal requirements with useful pictures to illustrate the point. It also sets out what happens in the event of an inspection and the remedies available to the County Council. It certainly does not pay to ignore notices that can be served as that is also a breach of the GAEC conditions under BPS compliance which will mean a penalty reduction is applied to the farm support payment.
