New regulations introduced on 6 April 2010 changed the system of waste exemptions. Farm-based exemptions registered before 6 April 2010 expired on 30 September 2013 and farmers were required to register a new exemption.
Any farmer who carries out a waste operation, allows waste to be spread on their land or stores waste material without a permit or written agreement is in danger of committing an offence. Farmers should be aware that penalties for failing to comply with the legislation are substantial with a maximum fine of £50,000.
