The attached briefing summarises the key changes. We have particular concerns about the presumption that interveners in judicial reviews will pay their own costs, and will also pay any costs they have caused to either party, because of their intervention.

The NFU has intervened in judicial review cases previously, and we are concerned that this reform will have a detrimental effect on the extent to which bodies such as the NFU will consider becoming involved in judicial reviews.”
