Defra consults on organic poultry derogations

The NFU will be responding to Defra's request for stakeholder feedback on organics derogations 2026.

Defra has launched a consultation on two key derogations that are critical to the future of the UK’s organic poultry sector.

These derogations are currently due to expire in December 2026, and the consultation seeks views on their potential continuation.

Key proposals

Defra is consulting on the ongoing use of:

  • Up to 5% non-organic protein feed in rations for pigs and poultry.
  • Non-organically reared pullets (up to 18 weeks of age) for use in organic egg production.

Importance to the organic poultry sector

Both derogations are widely considered essential for the continued viability of the organic poultry industry. Without them, producers would face significant challenges in meeting the nutritional requirements of poultry, particularly in sourcing sufficient organic protein.

The loss of these could therefore have direct consequences for animal welfare, as well as reducing production levels and availability of pullets.

Link to EU alignment and SPS discussions

These issues are also closely linked to ongoing discussions around a potential SPS (Sanitary and Phytosanitary) agreement with the European Union, which will include organic regulations.

The NFU has identified the continuation of these derogations as a key priority within this context.

Notably, the EU is also considering the extension of the 5% non-organic protein feed allowance. Should the UK align with EU organic regulations under an SPS agreement, any such EU decisions would directly apply to UK producers.

NFU position

The NFU recognises both derogations as essential to maintaining a functioning and resilient organic poultry sector. It will be formally responding to the consultation to ensure that the concerns of producers are clearly represented.

Defra seeks stakeholder engagement on extending derogations beyond December 2026

Defra is seeking stakeholder views on whether to extend two exceptional production rules (derogations) that are currently due to expire in Great Britain on 31 December 2026. These derogations allow for: 

  • the use of a maximum of 5% non-organic protein feed for pigs and poultry.
  • the use of non-organically reared pullets up to 18 weeks of age in organic egg production.

The consultation relates to arrangements for organic legislation as part of the SPS (Sanitary and Phytosanitary) Agreement between the UK and the EU. 

The NFU will be responding to the consultation on behalf of it's members before the consultation closes on 15 June.

Organic poultry feed rules set to change from 1 January 2026

Defra has shared its response to the April 2025 consultation on extending two key organic farming derogations for pig and poultry producers. These derogations were due to end on 31 December 2025.

Though the NFU welcomes the extension of the derogations, we have urged the government to keep it under close review. Read: Organic poultry feed rules set to change from 1 January 2026
